Allahabad High Court
PYARE LALversusSTATE OF U.P. AND 5 OTHERS
- Decided
Holding
The court ordered respondent no. 2 to decide the petitioner’s representation within sixty days, thereby disposing of the writ petition pending that determination.
Summary
The petitioner, Pyare Lal, a sugarcane grower, filed a writ petition alleging that a private company (respondent no. 6) had failed to pay dues owed for supplied sugarcane. The petitioner claimed that a representation filed with respondent no. 2 was still pending decision, and that no payment had been received, contrary to the respondent no. 5’s claim that 50 % of the amount had already been paid. The court noted the dispute over the payment and the pending representation. It directed respondent no. 2 to consider and decide the petitioner’s representation within sixty days of the order. Consequently, the writ petition was disposed of, pending the outcome of the representation. The order was pronounced on 5 May 2026 by Judges Atul Sreedharan and Vivek Saran.
Issues considered
- Whether the petitioner is entitled to the unpaid dues from the private company.
- Whether the representation filed with respondent no. 2 has been duly considered.
- Whether the claim of 50 % payment made by respondent no. 5 is accurate.
