Allahabad High Court

LAKHILALversusSTATE OF UP AND 3 OTHERS

Decided

Holding

The Court directed the respondent to decide the petitioner’s representation within one month, without adjudicating the substantive claims for extension of allotment or compensation.

Summary

The petitioner sought a writ of mandamus directing the Additional District Officer of District Panchayat Mathura to (i) extend the one‑year allotment of agricultural land allotted through public auction, (ii) compensate for a five‑month loss due to delayed possession, and (iii) decide a representation filed on 09‑04‑2026 within 15 days. The petitioner argued that the respondent had not acted on the representation. The Court examined the relief sought and, without addressing the merits of the land‑allotment or compensation claims, ordered the respondent to decide the representation within one month of receiving the certified copy of the order. The Court clarified that it was not adjudicating the substantive issues and left the respondent to apply the relevant rules and facts. The petition was therefore disposed with a direction limited to the pending representation.

Issues considered

  • Whether the High Court can issue a mandamus directing the respondent to extend the land‑allotment period.
  • Whether the petitioner is entitled to compensation for delay in granting possession of the allotted land.
  • Whether the Court can compel the respondent to decide the petitioner’s representation within a stipulated time.
