Allahabad High Court

MAHAVEER SINGH AND ANOTHERversusASSISTANT COLLECTOR FIRST CLASS (REVENUE)/ REVENUE OFFICER, AND 5 OTHERS

Decided

Holding

The High Court directed the Assistant Collector to decide the pending revenue case within twelve weeks, thereby exercising its supervisory jurisdiction under Section 117 of the U.P. Revenue Code, 2006.

Summary

The petitioners Mahaveer Singh and another filed a writ petition before the Allahabad High Court seeking a direction under Section 117 of the Uttar Pradesh Revenue Code, 2006, for the Assistant Collector (Revenue) to decide a pending revenue case (Case No. 2373 of 2025) that had been awaiting determination since 2025. The petition argued that the prolonged delay was unjustified and that an expeditious decision was necessary. The respondents contended that the petition was unnecessary because the case was already pending before the revenue officer. The Court observed that the continued pendency served no useful purpose and that the High Court could intervene to ensure timely disposal under its supervisory jurisdiction. Consequently, the Court disposed of the writ petition and directed the Assistant Collector to decide the pending case within twelve weeks, subject to service of notice and hearing of all parties. The order was signed on 6 May 2026.

Issues considered

  • Whether a High Court may issue a direction under Section 117 of the U.P. Revenue Code, 2006, compelling a revenue officer to decide a pending case within a specified time.
  • Whether the writ petition is maintainable when the underlying case is already pending before the revenue officer.
