Allahabad High Court

KANTAversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court directed the respondent to decide the pending case within eighteen months, without expressing any opinion on the merits.

Summary

The petitioner filed a writ petition seeking a mandamus directing the Additional Officer, Second, Sadar, District Azamgarh to decide a pending case (No. 10509 of 2022) under Section 144 of the U.P. Revenue Code, 2006. The petitioner alleged that despite several dates being fixed, the case remained undecided since 2022, causing undue delay. The court, after hearing counsel, declined to opine on the merits of the underlying case but found that the petition warranted disposal. It issued a direction to the respondent to decide the pending case expeditiously, preferably within eighteen months, after serving all parties and allowing hearing and evidence, and to avoid unnecessary adjournments. The petition was therefore disposed with the mandated direction.

Issues considered

  • Whether a writ of mandamus can be issued to compel an administrative officer to decide a pending revenue case under Section 144 of the U.P. Revenue Code, 2006.
  • Whether the delay in deciding the case violates the petitioner's right to speedy justice warranting judicial intervention.
