Allahabad High Court

RAM SAJEEVANversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court directed the Sub‑Divisional Officer to decide the pending proceedings expeditiously within three months, without expressing any opinion on the merits.

Summary

Ram Sajeevan filed a writ petition before the Allahabad High Court seeking a mandamus directing the Sub‑Divisional Officer, Chayal, to implement a prior directive dated 18‑02‑2025 and to conclude pending proceedings under Section 24(3) of the U.P. Revenue Code, 2006. The petitioner alleged that the proceedings had been pending since 2025 despite several dates being fixed, causing undue delay. The court noted that the petition required prompt disposal and, without expressing any view on the merits, ordered the SDO to decide the matter expeditiously. The order directed the SDO to complete the proceedings within three months of the certified copy of the order, after serving all parties and providing a hearing. The court also instructed that no unnecessary adjournments be granted unless a legal impediment existed. Consequently, the petition was disposed of finally with the mandated direction.

Issues considered

  • Whether the Sub‑Divisional Officer should be compelled by mandamus to comply with the earlier directive and conclude the proceedings under Section 24(3) of the U.P. Revenue Code, 2006 within a stipulated time.
