Allahabad High Court

GUDDI DEVI URF SHAKEELAversusCOMMISSIONER PRAYAGRAJ MANDAL AND 2 OTHERS

Decided

Holding

The Court directed the respondent to decide the pending appeal within six months, without granting unnecessary adjournments.

Summary

Petitioner Guddi Devi (Shakeela) filed a writ petition seeking an order directing the Commissioner of Prayagraj Mandal to hear and decide a pending appeal (appeal No. 1138/2024) that has been delayed since 2024. The petitioner argued that multiple dates had been fixed but the appeal remained undecided, causing undue hardship. The Court noted that keeping the writ petition pending served no useful purpose and, without addressing the merits of the underlying appeal, ordered the respondent to decide the appeal expeditiously. The Court directed that the appeal be decided within six months of the certified copy of the order, after service on all parties and without unnecessary adjournments, provided no other legal impediment exists. The petition was therefore disposed of with the specified direction.
