Allahabad High Court
SHREE GANESH ENTERPRISESversusMANAGING DIRECTOR UP JAL NIGAM GRAMIN 6 RANA PRATAP MARG LUCKNOW AND 4 OTHERS
- Decided
Holding
The Court directed respondent No.4 to consider the petitioner's grievance and decide within two months, and to pay any amount due within four weeks, with interest at 8% for delay.
Summary
Shree Ganesh Enterprises filed a writ petition under Article 226 of the Constitution seeking the release of amounts due for work performed under a contract with the Managing Director, Up Jal Nigam Gramin and others. The respondents contended that the petitioner had already raised the grievance through a representation dated 14-02-2026 and that the competent authority to decide the matter was respondent No.4. The Court examined whether the petitioner's claim could be entertained directly or whether the pending representation should first be considered. It held that the pending representation must be dealt with by the competent authority before any payment can be ordered. Accordingly, the petition was disposed with a direction that respondent No.4 decide the grievance within two months and, if an amount is found payable, release it within four weeks, with interest at 8% for any delay.
Issues considered
- Whether the writ petition under Article 226 is maintainable for the release of contract payment pending a representation before the authority.
