Allahabad High Court

TULSIRAM AND 2 OTHERSversusSTATE OF U.P. AND 7 OTHERS

Decided

Holding

The petition is disposed with a direction to the respondent to decide the pending case expeditiously.

Summary

The petitioners, Tulsiram and two others, filed a writ petition seeking a direction to the third respondent to decide a pending civil case (No. 11113 of 2024, Sita Ram & Others vs Nagar Panchayat Harraiya & Others) under Section 24 of the U.P. Revenue Code, 2006, and to maintain a status‑quo on a disputed land parcel (Arazi No. 421). The petition also alleged that respondents 5‑8 were attempting illegal possession of the land. The Court observed that the underlying case had been pending since 2024 and that keeping the writ petition alive served no useful purpose. Consequently, the Court disposed of the writ petition, directing the third respondent to decide the pending case expeditiously, preferably within three months, after serving notice to all parties and providing a hearing, subject to no other legal impediment. The order also implicitly upheld the request for a status‑quo pending the final decision.

Issues considered

  • Whether the High Court can direct a lower authority to decide a pending case under Section 24 of the U.P. Revenue Code, 2006.
  • Whether a status‑quo order can be maintained on the disputed land pending the disposal of the pending case.
