Allahabad High Court

PRATEEK PANDEYversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court directed the respondent to register and decide the pending revenue case expeditiously, within six months, by mandamus.

Summary

Petitioner Prateek Pandey filed a writ petition seeking a mandamus directing the second respondent, a revenue authority, to register and decide a pending case under sections 34 and 35 of the Uttar Pradesh Revenue Code, 2006, dated 14 January 2026. The petitioner alleged that despite several dates being fixed, the case remained undecided and urged expeditious disposal. The Court, after hearing counsel, found no merit in keeping the petition pending and, without addressing the substantive merits of the underlying revenue case, ordered the respondent to register and decide it within six months of the certified copy of the order, ensuring service and hearing, and to avoid unnecessary adjournments. The direction was issued in the nature of mandamus to enforce the statutory duty under the Revenue Code. The petition was consequently disposed of with the specified directive.
