Holding
The Court directed the Sub‑Divisional Magistrate to reinstall the pillars within two months, notwithstanding the water‑logging issue.
Summary
The petitioner sought re‑installation of demarcation pillars that had been installed under an order passed pursuant to Section 24 of the Uttar Pradesh Revenue Code on 06‑06‑2022, but were later removed by private individuals, leading to an FIR and a final report. The petitioner applied to the Sub‑Divisional Magistrate, Soraon, for reinstatement of the pillars. The magistrate indicated that the land was water‑logged and that the water needed to be subsidized before any re‑installation could occur. The High Court examined whether the water‑logging justified a delay and found that the magistrate should act to reinstall the pillars. Consequently, the Court disposed of the petition, directing the Sub‑Divisional Magistrate to complete the re‑installation within two months of the certified copy of the order.
Issues considered
- Whether the Sub‑Divisional Magistrate is obligated to reinstall the demarcation pillars despite the presence of water‑logging on the land.
- Whether the delay caused by water‑logging is a valid ground to defer compliance with the order under Section 24 of the U.P. Revenue Code.
