Allahabad High Court

DINESH KUMAR SINGHversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court directed the Additional Commissioner (Judicial) to decide the pending appeal within three months, without expressing any view on the merits.

Summary

Petitioner Dinesh Kumar Singh filed a writ petition seeking a mandamus directing the Additional Commissioner (Judicial) Prayagraj Division to dispose of his appeal under Section 24(4) of the U.P. Revenue Code, 2006, which has been pending since 30 September 2024. The petitioner argued that the appeal was not being progressed expeditiously and submitted the order sheet as evidence. The Court, after hearing counsel for both sides, declined to opine on the merits of the appeal but ordered the respondent to decide the matter within three months of the certified copy of the order, without unnecessary adjournments. The direction was issued as a mandatory order to ensure speedy disposal. The petition was consequently disposed of with the said directive.
