Allahabad High Court

PARASHURAM RAIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The writ petition is dismissed; the petitioner must file a new demarcation application that complies with the Uttar Pradesh Revenue Code, 2006.

Summary

The petitioner filed a writ petition seeking a mandamus directing the Deputy District Magistrate of Ballia to register and decide two applications for demarcation of arazies filed on 30‑04‑2025 and 02‑06‑2026. The petitioner alleged that the applications had not been registered, while the State contended that the applications were non‑compliant with the Uttar Pradesh Revenue Code, 2006 and its Rules, and therefore could not be registered under Section 24 of that Code. The Court examined the procedural requirements under the Revenue Code and found the petitioner’s applications deficient. Consequently, the Court disposed of the writ petition, granting the petitioner liberty to file a fresh, compliant application for demarcation. No order directing the magistrate to act on the original applications was issued.

Issues considered

  • Whether the Deputy District Magistrate is obligated to register and decide the demarcation applications filed by the petitioner.
  • Whether the applications filed on 30‑04‑2025 and 02‑06‑2026 complied with the provisions of the Uttar Pradesh Revenue Code, 2006 and its Rules, particularly Section 24.
