Holding
The Court directed Respondent No.2 to decide the pending revenue case within six months, subject to no legal impediment, thereby granting the writ of mandamus.
Summary
Petitioner Sanjay Kumar filed a writ petition seeking a mandamus directing Respondent No.2 to decide the pending revenue case Sanjay Pathak v. State of U.P. (Case No. RST/2247/2026) filed under Section 209(Ja) of the U.P. Revenue Code, 2006. The petitioner argued that the case had been pending for an inordinate period and required expeditious disposal. The State's standing counsel raised no objection to the relief sought. The Court, after hearing counsel, ordered that Respondent No.2 decide the case within six months of the certified copy of the order, subject to the absence of any legal impediment. Consequently, the writ petition was disposed of with the mandated direction.
Issues considered
- Whether the High Court can issue a writ of mandamus directing a revenue authority to decide a pending case expeditiously.
