Allahabad High Court

SURESH SINGH @ SURESH KUMAR SINGHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The writ petition is not maintainable as the petitioner has an alternative remedy of appeal under Section 67(5) of the U.P. Revenue Code, 2006.

Summary

The petitioner, Suresh Singh, filed a writ petition seeking a certiorari to quash an eviction and damages order dated 18.02.2026 issued by the Assistant Collector/Tehsildar under Section 67 of the U.P. Revenue Code, 2006, and also sought a mandamus directing the recovery of Rs. 18,000 in damages. The petitioner argued that the encroachment had been removed by him, rendering the damages order arbitrary, and contended that an appeal was not barred. The State, through its Additional Chief Standing Counsel, maintained that an alternative remedy of appeal under Section 67(5) of the same Code was available, rendering the writ petition inadmissible. The Court examined the record, noted that the order could indeed be challenged by appeal, and held that the writ petition could not be entertained. Consequently, the Court disposed of the petition, directing the petitioner to file an appeal within three weeks, with liberty to seek condonation of delay, and ordered service of the judgment to the Land Management Committee counsel.

Issues considered

  • Whether the writ petition is maintainable when an alternative remedy of appeal under Section 67(5) of the U.P. Revenue Code, 2006 is available.
  • Whether the order of eviction and damages passed by the Tehsildar can be set aside by a writ of certiorari.
