The Court directed the Sub‑Divisional Officer to decide the pending suit and stay application expeditiously, within six months, without expressing any opinion on the merits.
Summary
The petitioner filed a writ petition seeking a mandamus directing the Sub‑Divisional Officer (respondent No.2) to decide a stay application dated 16‑April‑2026 and a suit for division of holding pending before the Sub‑Divisional Magistrate, Kasya, under Section 116 of the U.P. Revenue Code, 2006. The petitioner also asked for a status‑quo order against private respondents concerning possession of a specific plot of land. The Court noted that the suit and stay application were indeed pending and that there was no dispute on this fact. Emphasising the interest of justice, the Court ordered the respondent to decide the pending suit and all related applications expeditiously, preferably within six months, after giving a proper hearing, without expressing any view on the merits. The petition was consequently disposed with the said directions.
