JIYA LALversusTHE STATE OF U.P. AND 16 OTHERS

Decided

Holding

The order dated 6 July 2026 passed by the Sub Divisional Officer is confirmed and the writ petition is dismissed.

Summary

The petitioner sought a writ of certiorari and mandamus to quash the order dated 6 July 2026 of the Sub Divisional Officer that rectified plot no. 962 under Section 24 of the U.P. Revenue Code, 2006 and to maintain a status‑quo on the patthargarhi. He alleged that the revenue report relied upon was improper and that his objection was not considered, rendering the order illegal. The respondents contended that the order was appealable, that the objection had been duly taken into account, and that the proceeding was proper. The Court examined the impugned order and found that the objection was indeed considered and that the Sub Divisional Officer acted within his jurisdiction based on the revenue report. Accordingly, the Court held that there was no ground for interference under Article 226 of the Constitution and dismissed the writ petition.

Issues considered

  • Whether the order of the Sub Divisional Officer under Section 24 of the U.P. Revenue Code, 2006 is amenable to writ jurisdiction under Article 226
  • Whether the petitioner's objection was duly considered in the revenue proceeding
  • Whether the writ petition is maintainable despite the existence of an appeal against the order

patthargarhi made by the department, during the

3. Learned counsel for the petitioner submitted that in the proceeding
under section 24 of U .P. Revenue Code, 2006 initiated by
respondent no.5 report was not submitted in proper manner. He
submitted that on the basis of the wrong report, Sub Divisional Officer
has illegally allowed the proceeding under Section 24 of U.P.
Revenue Code, 2006, without considering the petitioner's objection in
proper manner, as such impugned order should be set aside. He
submitted that alternative remedy against the impugned order will not
be bar for the petitioner to challenge the impugned order dated
06.07.2026 before this Court as impugned order has been passed on
the basis of illegal report and without considering the petitioner's
objection.

4. On the other hand, Mr. Nand Lal Maurya, learned Standing
Counsel for the State-respondents and Mr. Bhupendra Kumar
Tripathi, learned counsel for gram sabha submitted that impugned

They further submitted that objection filed on behalf of petitioner was
taken into consideration recording finding that proceeding under
Section 24 of U.P. Revenue Code, 2006 was initiated by the
respondent no.5 in respect to plot no. 962 and civil suit has been
filed by the petitioner in respect to plot no.961. They submitted that a

rightly passed by the Sub Divisional Officer, which requires no
interference.

the parties and perused the record.

6. There is no dispute about the fact that private respondent no. 5 is
recorded owner of plot no. 962 and proceeding under Section 24 of
U.P. Revenue Code, 2006 was initiated by respondent no. 5 in
respect to plot no. 962, which has been allowed under the impugned
order.

                                                                                      WRIC No. 34242 of 2026
                                                                 5

plot no.962. Perusal of order also demonstrates that proceeding

private respondent no. 5 in respect to her plot no. 962 and petitioner

for interference in exercise of jurisdiction under Article 226 of the
Constitution of India against the impugned order dated 6.7.2026
passed by respondent no.3/Sub Divisional officer in the proceeding
