Allahabad High Court
SALONIversusUNION OF INDIA AND ANOTHER
- Decided
Holding
The petition cannot be entertained unless the petitioner first obtains a Gazette notification of the name change as mandated by the Janhit Guarantee Act, 2011.
Summary
Petitioner Saloni filed a writ petition under Article 226 seeking a direction to the Union of India to correct her name in the Aadhaar database from ‘Sanoli’ to ‘Saloni’. The respondent argued that a mere representation is insufficient and that, under the Janhit Guarantee Act, 2011, the petitioner must first obtain a Gazette notification of the name change. After securing the Gazette notification, she must file an application with the regional Aadhaar office, which must then decide within six weeks. The court noted these procedural requirements and did not grant the relief sought. Consequently, the petition was disposed without ordering any change in the Aadhaar records.
