Allahabad High Court

BRIJ MOHANversusUNIQUE IDENTIFICATION AUTHORITY OF INDIA AND 3 OTHERS

Decided

Holding

A name change in Aadhaar records requires a Gazette notification and a subsequent application to UIDAI, which must be decided within six weeks.

Summary

Petitioner Brij Mohan filed a writ petition under Article 226 seeking a direction to UIDAI and its regional office to correct his name from 'Ramvriksh' to 'Brij Mohan' in his Aadhaar record. The respondents contended that the petitioner must first obtain a Gazette notification of the name change as mandated by the Janhit Guarantee Act, 2011, and thereafter file an application with the UIDAI regional office. The court accepted this procedural requirement, noting that a mere representation is insufficient. It held that after the Gazette notification, the petitioner may apply to the respondents for the correction, which must be decided within six weeks. Accordingly, the petition was disposed without granting the relief sought.

Issues considered

  • Whether a petitioner can directly seek a court direction for name correction in Aadhaar under Article 226 without complying with statutory procedure.
  • Whether the Janhit Guarantee Act, 2011 requires a Gazette notification before a name change can be effected in Aadhaar records.
