Allahabad High Court
PRIYANSHU PANWARversusUNION OF INDIA AND 5 OTHER
- Decided
Holding
The petitioner must file a fresh passport re‑issuance application with his High School Certificate, and the Regional Passport Officer shall decide the correction within two months.
Summary
The petitioner filed a writ petition under Article 226 seeking re‑issuance of his passport with the date of birth corrected to match his High School Certificate. He alleged that the passport issued in 2014 contained an incorrect date of birth and that his subsequent application for correction was closed. The Court examined whether the petitioner could be directed to obtain a corrected passport. It held that the petitioner should file a fresh application for re‑issuance, attaching the High School Certificate as proof of the correct date of birth. The Regional Passport Officer was directed to consider the application and decide within two months of receiving the certified copy of the order. Accordingly, the writ petition was disposed with these directions.
Issues considered
- Whether the petitioner is entitled to re‑issuance of his passport with the date of birth corrected as per his High School Certificate under Article 226.

Court No. - 1
HON'BLE AJIT KUMAR, J.
HON'BLE SIDDHARTH NANDAN, J.
1. Heard learned counsel for the parties.
2. By means of this petition filed under Article 226 of the Constitution,
petitioner seeks re-issuance of his passport with the correct date of birth as
recorded in his High School Certificate.
3. It is contended that in the year 2014, the passport was initially issued to
the petitioner with a date of birth which was not the same as that
subsequently recorded in his High School Certificate. However, he submits
that his application for re-issuance of the passport has now been closed.
4. In view of the above, we dispose of the writ petition with direction to the
petitioner to apply afresh for re-issuance of the passport along with his High
School Certificate. If he does so, since the High School Certificate is a
recognised document for all official purposes, the Regional Passport Officer
concerned shall consider and dispose of the application of the petitioner for
correcting the date of birth as per the High School Certificate. The
appropriate decision shall be taken by the Regional Passport Officer within a
period of two months from the date of presentation of certified copy of this
order along with the fresh application for re-issuance of the passport.
