Allahabad High Court
BHAGWAN PRASAD AND ANOTHERversusSTATE OF U.P. AND 4 OTHERS
- Decided

- CHANDRA KUMAR RAI
Holding
The Court held that the district magistrate must decide the pending restoration application within six weeks of the order.
Summary
The petitioners challenged an eviction and damages order, alleging that the district magistrate had illegally rejected their restoration application. They filed a writ petition seeking mandamus to compel the district magistrate to decide the pending restoration application within a fixed period and to stay the effect of the eviction order. The State and the Gaon Sabha argued that the matter should be pursued through the ordinary appeal process and that no writ interference was warranted. The Court observed that the appeal by petitioner No.2 had been dismissed and the restoration application dated 17‑06‑2026 remained pending before the district magistrate. Considering the circumstances and the interest of justice, the Court directed the district magistrate to decide the restoration application expeditiously, preferably within six weeks, and disposed of the petition.
Issues considered
- Whether the district magistrate should be directed by a writ of mandamus to decide the pending restoration application within a stipulated time
- Whether the order of eviction and damages can be stayed pending the decision of the restoration application
- Whether the writ jurisdiction is appropriate when an ordinary appeal is available
