Allahabad High Court

HARISH CHANDRA MISHRA AND 5 OTHERSversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court declined to grant mandamus and instead directed the respondent authority to consider and decide the petitioners' representation in accordance with law.

Summary

The petitioners sought a writ of mandamus directing the State to release two plots of land allotted for an OPEC Hospital or, alternatively, to acquire the land under Section 24 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act, 2013 with adequate compensation. They alleged that despite repeated representations, no decision or compensation had been provided and the land remained unutilised. The State respondents raised no objection to an expedited consideration of the petitioners' representation dated 07‑09‑2024. The Court, without addressing the merits of the mandamus claim, disposed of the petition by directing the Principal Secretary, Urban Development Department, to consider and decide the representation expeditiously and in accordance with law. Consequently, no order releasing the land or directing acquisition was issued.

Issues considered

  • Whether the Court should issue a writ of mandamus directing the release of the disputed land to the petitioners.
  • Whether the State is obligated to acquire the land under Section 24 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act, 2013 with compensation.
  • Whether the petitioners' representation dated 07‑09‑2024 should be decided expeditiously by the respondent authority.

                                                                    2
