Allahabad High Court

RAM SINGHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The order dismissing the writ petition is not illegal and the petition is dismissed.

Summary

The petitioner, Ram Singh, approached the Permanent Lok Adalat for dispute resolution, but the matter was already pending before a competent civil court and a civil suit had been filed. Under Sections 22-C(1) and 22-C(2) of the Legal Services Authority Act, 1987, the Lok Adalat proceedings were consequently dropped. The petitioner’s counsel could not demonstrate that the existence of the pending civil suit was erroneous or that it could be ignored. The court found no illegality in the order that dismissed the petition. Accordingly, the writ petition was dismissed.

Issues considered

  • Whether the order dismissing the writ petition is illegal in view of the pendency of a civil suit under Sections 22-C(1) and 22-C(2) of the Legal Services Authority Act, 1987
