Allahabad High Court

RAVINDRA RAIversusUNION OF INDIA AND 5 OTHERS

Decided

Holding

The petition is disposed of with directions to the petitioner to follow the procedural guidelines from the cited judgments and for the Regional Passport Officer to dispose of the application accordingly.

Summary

Petitioner Ravindra Rai filed a writ petition under Article 226 seeking disposal of his pending passport application. The respondents argued that the petitioner had been served a show‑cause notice because of several criminal cases pending against him under the Indian Penal Code, the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and the Criminal Law Amendment Act. The Court examined whether the passport could be processed in view of these pending cases and referred to procedural guidelines laid down in the recent judgments of Rahimuddin v. Union of India & Another and Wajiruddin Khan v. Union of India & 2 Others. It directed the petitioner to comply with the procedures prescribed in those judgments and instructed the Regional Passport Officer to dispose of the application accordingly. Accordingly, the petition was disposed of.

Issues considered

  • Whether a passport application can be processed when the applicant has pending criminal cases under the IPC and other statutes.
  • What procedural steps must the applicant follow as per the guidelines laid down in earlier Supreme Court/High Court judgments.
