Allahabad High Court
M/S GS EXPRESS LIMITEDversusSTATE OF U.P. AND 6 OTHERS
- Decided
Holding
The writ petition is dismissed at this stage pending the tender authority's adjudication of the notice.
Summary
The petitioners, GS Express Ltd., challenged the declaration of Respondent No.7 as the L‑1 bidder and technically qualified in Tender No. YEA/GM(P)/2026/495, alleging procedural irregularities, improper consideration of subcontractor experience, and incorrect bid capacity calculations. They sought certiorari to quash the declaration and mandamus to compel the tender authorities to cancel the qualification, re‑evaluate bids, or restart the tender process. The respondents argued that the issues raised were already addressed in a notice dated 8 September 2026 and that a reply to the notice was pending adjudication. The Court observed that the matter was still sub‑judice before the tender authority and that no final order could be passed until the pending adjudication was concluded. Consequently, the Court dismissed the writ petition at this stage, reserving the right to hear the petitioners should they file an application thereafter.
Issues considered
- Whether the declaration of Respondent No.7 as L‑1 bidder and technically qualified can be quashed on grounds of procedural irregularities.
- Whether the tender authority must cancel the technical qualification and re‑evaluate financial bids in accordance with the NIT eligibility criteria.
- Whether the experience of Respondent No.7 as a subcontractor can be counted as qualifying experience under the NIT.
- Whether the bid capacity of Respondent No.7 should be recalculated excluding GST and scrap sale proceeds and including existing contractual commitments.
- Whether the Court can intervene before the tender authority completes its adjudication of the notice dated 8‑9‑2026.
