Allahabad High Court

HARIJAN SIKSHA SAMITI AND ANOTHERversusTHE COMMISSIONER KANPUR DIVISION KANPUR AND 5 OTHERS

Decided

Holding

The court directed the respondent to decide the pending appeal within three months, provided there is no legal impediment.

Summary

The petitioners, Harijan Siksha Samiti and another, filed a writ petition seeking an order that the appeal they had filed (No. 152/2026) under the Societies Registration Act, 1860 be decided expeditiously. The respondents, including the Commissioner of Kanpur Division, agreed to consider the appeal promptly. The court, after hearing counsel, noted there was no legal impediment to directing a speedy decision. Consequently, the court disposed of the writ petition, directing the respondent to decide the pending appeal, if any, within three months from the date of the order. No substantive merits of the appeal were addressed; the focus was solely on procedural expeditious disposal.
