Allahabad High Court

GEETA DEVI GRAM PRADHANversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that it may grant liberty to the petitioner to file a fresh writ petition under Section 72(4) of the U.P. Revenue Code.

Summary

The petitioner, Geeta Devi, a Gram Pradhan, filed a writ petition seeking permission to file a fresh petition with better particulars under Section 72(4) of the Uttar Pradesh Revenue Code. The petitioner argued that the original petition lacked sufficient details and that the court should allow a re-filing. The respondent State of U.P. and others opposed the relief. The court examined the procedural provisions of Section 72(4) and found no impediment to granting liberty for a fresh filing. Consequently, the court disposed of the writ petition, granting the petitioner liberty to file a new petition with the required particulars. No substantive merits of the underlying dispute were addressed.
