Allahabad High Court

BRIJRAJ SINGHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The court held that the petitioner must obtain the new caste certificate through the prescribed online application process and that mandamus is not warranted.

Summary

The petitioner, Brijraj Singh, filed a writ petition seeking mandamus directing the State of U.P. (respondent No. 3) to upload his new caste certificate on the E‑District website in place of the old 1988 manual certificate, and also to decide his representation dated 18‑08‑2026 within the stipulated period. The court observed that the petitioner can apply for a computerized caste certificate through the prescribed online portal, after which the authority will issue the certificate following the statutory enquiry. It noted that the existing procedural mechanism suffices and there is no basis to compel the authority by mandamus to upload the certificate. Accordingly, the petition was disposed of without granting the reliefs. The decision emphasizes that administrative compliance with the established online process is adequate and mandamus is not appropriate where a statutory remedy is available.

Issues considered

  • Whether the court can issue a mandamus directing the respondent to upload the petitioner’s new caste certificate on the E‑District website.
  • Whether a mandamus can be issued directing the respondent to decide the petitioner’s representation within the stipulated period.

                                    1. Heard learned counsel for the petitioner and learned Standing Counsel for
                                    the State.

                                    2. This writ petition has been filed for the following reliefs:

"I) Issue a writ, order or direction in the nature of Mandamus Commanding and
directing the respondent No. 3 to upload the New caste certificate of the petitioner on
Official Government Website i.e. E-District Uttar Pradesh in place of old caste
                                    certificate dated 02.08.1988.

                                    18.08.2026 within stipulated period."

                                    3. From the record, it appears that the petitioner was issued a caste certificate
in the year 1988, which was issued manually. The petitioner now desires a
computerized certificate. In this regard, the petitioner may apply online
through the prescribed portal and thereafter a copy of the computerized
certificate be issued accordingly, after enquiry as contemplated under law.

                                    4. With these observations, the writ petition stands disposed of.

                                                                    (Kunal Ravi Singh,J.) (Siddhartha Varma,J.)
