Allahabad High Court

PAWAN KUMAR SINGHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The High Court directed the Sub Divisional Magistrate to decide the pending application within three months, without adjudicating the merits of the underlying land dispute.

Summary

The petitioner filed a writ petition seeking a direction to the Sub Divisional Magistrate of Mirzapur to decide an application filed on 22 April 2026 under Section 24 of the Uttar Pradesh Revenue Code, 2006, for measurement and demarcation of specific land parcels. The petition alleged that the application, registered as Case No. T202616530127082 on 19 August 2026, was pending without a decision. The Court, without expressing any view on the merits of the land dispute, exercised its supervisory jurisdiction to ensure speedy disposal. It directed the Sub Divisional Magistrate to conclude the pending proceeding within three months of receiving a certified copy of the order, after providing a proper hearing to the parties. The order was issued on 17 September 2026, and the petition was disposed with the said direction.
