Holding
The writ petition is not maintainable where an alternative statutory remedy under Section 207 of the UP Revenue Code, 2006 exists.
Summary
The petitioner, Anant Bahadur Singh, filed a writ petition challenging a judgment and order dated 15 April 2026 passed under Section 144 of the Uttar Pradesh Revenue Code, 2006. The standing counsel raised a preliminary objection that the petitioner had an alternative statutory remedy by filing an appeal under Section 207 of the same Code. The Court examined whether the writ petition was maintainable given the existence of this alternative remedy. It held that because the petitioner could pursue the appeal under Section 207, the writ petition was not maintainable. Consequently, the Court dismissed the writ petition, allowing the petitioner to avail the appropriate statutory remedy.
