Allahabad High Court

TRIVENI RAMversusSTATE OF U.P. AND 11 OTHERS

Decided

Holding

The Court directed the Commissioner, Azamgarh Division, to decide the pending case within three months, thereby granting the writ of mandamus.

Summary

The petitioner, Triveni Ram, filed a writ petition under Article 226 of the Constitution seeking a mandamus directing the Commissioner of Azamgarh Division to decide a pending revenue case (Case No. 218/2022) under Section 210 of the U.P. Revenue Code, 2006. The petitioner alleged that the case had been pending since 19 January 2022 and requested an expeditious decision. The standing counsel for the respondent had no objection to the petition being disposed of with a direction to the Commissioner. The High Court, after hearing counsel, ordered that the Commissioner decide the pending case within three months of receiving a certified copy of the order. No substantive reasoning beyond the need for timely disposal was provided. The petition was thus disposed of with the specified direction.
