Allahabad High Court
RANG BAHADURversusSTATE OF UTTAR PRADESH AND 6 OTHERS
- Decided
Holding
The Court did not issue a mandamus but directed the respondent authority to decide the pending representation within two months.
Summary
Petitioner Rang Bahadur filed a writ petition under Article 226 of the Constitution seeking a mandamus directing the Executive Officer of Nagar Palika Parishad Mungra Badshahpur, Jaunpur to correct the death date of Shyam Lal from 01‑08‑1984 to 25‑07‑1982 as recorded on 14‑01‑2022. The petitioner had earlier filed an application/representation on 17 July 2026 before the same authority, which remained pending. The State’s standing counsel expressed no objection to the court directing the authority to decide the pending representation in accordance with law. The Court, after hearing counsel, declined to issue a mandamus for correction and instead ordered the respondent to decide the pending application within two months of receiving a certified copy of the order. The petition was therefore disposed with the said direction.
Issues considered
- What relief, if any, can be granted under Article 226 for correction of a death date recorded by a municipal authority?
- Whether the Court should issue a mandamus directing immediate correction, or merely direct the authority to decide the pending representation of the petitioner.
