Allahabad High Court

RABAL SINGH AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

A writ petition may be dismissed as not pressed when the petitioner elects not to pursue it, with liberty to file a fresh petition.

Summary

The petitioners, Rabal Singh and another, filed a writ petition before the Allahabad High Court. During the hearing, the petitioners informed the Court that they no longer wished to pursue the petition and requested its dismissal as not pressed. The Standing Counsel for the State and the counsel for the contesting respondents agreed to this request. The Court, after noting the parties' consent, dismissed the writ petition as not pressed, granting the petitioners liberty to file a fresh petition if they choose. No substantive merits of the petition were examined, and the dismissal was purely procedural.
