Allahabad High Court

RIFAT BANOversusUNION OF INDIA AND 3 OTHERS

Decided

Holding

The court ordered the cancellation of the original Aadhaar cards and the issuance of fresh cards with correct biometrics for both petitioners.

Summary

The petitioners, minor children Rifat Bano and Jigyansh, filed writ petitions after their biometric data were interchanged during Aadhaar enrolment at a Union Bank of India franchise. The error resulted in each child's biometrics being linked to the other's Aadhaar number, a fact admitted by the respondents. The court found no complex legal issue and directed the respondents to cancel the erroneous Aadhaar cards and issue fresh cards with correct biometric entries within 40 days. The order ensures that the children’s identities are correctly reflected in the Aadhaar database. Consequently, both petitions were disposed of after granting the relief.

                 HON'BLE SIDDHARTH NANDAN, J.

1. A common order is being passed to dispose of both petitions. The issue
involved is not complex.

2. Both these petitioners are minor children who had gone to get their
Aadhaar Card prepared by a Union Bank of India UADAI franchisee
operating within the premises of the Union Bank of India at Prayagraj.
The petitioners are Rifat Bano (Aadhaar No.6770 6418 8261) and
Jigyansh (Aadhaar No. 3579 9913 4198). Both children had their
biometrics entered into the database of respondents Nos. 1 to 3 on the
same day and at approximately the same time. During this process, the
biometrics of the two children were interchanged. As a result, the
biometrics of Jigyansh were linked to the Aadhaar details of Rifat Bano,

and vice versa. This position is admitted even by the respondents.

                                    3. Therefore, both these petitions are disposed of with a request to
respondents Nos. 1 to 3 to cancel the original Aadhaar cards, if not done
already; and prepare fresh Aadhaar cards for both the petitioners, ensuring
that their respective biometrics are correctly entered against their Aadhaar
details. This exercise be carried out within 40 days from the date of
                                    communication of this order.
