KAUSHAL KISHORE RAI AND 6 OTHERSversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The petition is disposed with a direction to the State to examine the claim and grant the subsidy, if the petitioners are found entitled, within thirty days.
Summary
The petitioners, Kaushal Kishore Rai and six others, filed a writ petition seeking a subsidy of Rs 1,50,200 for a 9 HP power trailer they had purchased, claiming entitlement under the Rajya Audyogik Mission, Uttar Pradesh and the Ekikrit Bagwani Vikas Mission (Rashtriya Bagwani Mission). The central issue was whether the petitioners were eligible for the subsidy under the said schemes. The Court examined the petition and, without delving into detailed factual findings, directed the State to scrutinise the petitioners’ claim and, if they are found eligible, to release the subsidy within thirty days of the order. No substantive legal reasoning on the eligibility criteria was articulated. Consequently, the petition was disposed of, with a specific direction to the State to act within the stipulated time‑frame.
