Allahabad High Court
SMT. MANSA DEVIversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The Court held that mandamus is appropriate and directed the District Magistrate to decide the pending application within 30 days.
Summary
Smt. Mansa Devi filed a writ petition seeking relief from the State of U.P. for its failure to decide her application filed on 13‑08‑2025 under the Mukhyamantri Krishak Durghatana Kalyan Yojana after her husband’s death. The Court noted that the scheme is intended to provide social security to families of deceased agriculturists and that officials have a statutory duty to consider such claims promptly. It observed that, although the scheme prescribes a timeline, the State often does not adhere to it, causing undue hardship to beneficiaries. Consequently, the Court issued a mandamus directing the District Magistrate to decide the pending application within thirty days of service of the order, interpreting the scheme’s conditions in a manner conducive to its purpose. The petition was thereafter disposed.

Court No. - 2
HON'BLE ATUL SREEDHARAN, J.
HON'BLE SIDDHARTH NANDAN, J.
1. This writ petition has been filed by the petitioner, who is aggrieved by
the inaction on the part of the State in deciding her application filed on
13.08.2025 under the "Mukhyamantri Krishak Durghatana Kalyan
Yojana" consequent upon the passing away of her husband. Admittedly,
the authority concerned has not decided the said application.
2. Considering the nature and objective of the scheme which has been
promulgated by the Government, which is substantially for providing the
social security to the family of the deceased agriculturist, who is left in
destitution, on account of the sudden demise of the sole breadwinner, we
are of the view that it is an onerous duty of the Government Officials,
who are vested with the duty, to consider the claims of such beneficiaries,
in the most expeditious manner.
3. Though the scheme provides for timeline but it is often found that the
said timeline is not being adhered to and under such circumstances, we
think it appropriate to issue directions for effective implementation of the
"Mukhyamantri Krishak Durghatana Kalyan Yojana".
4. In view of the aforesaid, a mandamus is issued to the District
Magistrate to consider and decide the pending application of the
petitioner under the "Mukhyamantri Krishak Durghatana Kalyan Yojana"
as expeditiously as possible preferably within a period of 30 days from
the date of service of this order. It is also clarified that the conditions
enumerated in the aforesaid scheme is to be read in a manner which is

conducive to the objective of the scheme.
5. With the aforesaid directions, the present writ petition stands disposed
of.
