Allahabad High Court
UTTAM BASAURversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The applicant is entitled to bail.
Summary
Uttam Basaur applied for bail in a criminal case (Crime No. 499 of 2025) alleging gang rape of a 14‑year‑old girl under Sections 332(b), 70(2), 351(3) of the BNS Act and Sections 5(g) and 6 of the POCSO Act. The applicant claimed false implication, a delayed FIR originally lodged in Madhya Pradesh, disputed age determination of the victim, and lack of supporting medico‑legal evidence, while asserting no prior criminal record. The State opposed bail, relying on the victim’s statement under Sections 180 and 183 of the BNSS and the seriousness of the alleged offence. The Court, invoking Supreme Court precedents (Kapil Wadhawan v CBI, Maya Tiwari v State of U.P.) and considering jail overcrowding, held that bail could be granted without expressing a view on the merits. Accordingly, the bail application was allowed with standard conditions and verification requirements.
Issues considered
- Whether bail should be granted to the accused in a gang‑rape case involving a minor under the BNS and POCSO Acts despite the seriousness of the allegations.
- Whether the delay in filing the FIR, disputed age of the victim, and lack of corroborative medical evidence affect the bail decision.
- Whether the principles laid down in Supreme Court judgments on bail and jail overcrowding apply to this case.
