Allahabad High Court

KHADAK SINGH @ ARJUNversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The bail application was dismissed as infructuous because the applicant had already been convicted.

Summary

The applicant, Khadak Singh, filed a bail application in a criminal case (Crime No. 140 of 2024) alleging offences under several IPC sections, the B.N.S Act and the POCSO Act. The Special Judge (POCSO) had already concluded the trial and delivered a conviction on 30 September 2025. The State's brief holder and the informant's counsel confirmed the conviction. The High Court noted that the bail application was filed after the judgment and therefore was moot. Consequently, the court dismissed the bail application as infructuous.

Issues considered

  • Whether a bail application can be entertained after the accused has been convicted.
  • Whether the bail application is maintainable in view of the final judgment.
