Allahabad High Court

HASIB SALMANI AND 2 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court quashed the criminal proceedings against the applicants, holding that a valid settlement effected through mediation warrants dismissal of the case.

Summary

The applicants, Hasib Salmani and two others, filed an application under Section 528 of the BNSS seeking to quash the charge‑sheet, cognizance order and the entire criminal proceedings (Case No. 7502 of 2025) arising out of Crime No. 237 of 2024, which involved offences under sections 85, 115(2), 352, 351(2) of the B.N.S. Act, sections 3/4 of the D.P. Act and the Muslim Women (Protection of Rights on Marriage) Act, 2019. The matter was referred to the Court’s Mediation and Conciliation Centre, where the parties reached an amicable settlement and agreed to withdraw all pending cases against each other. The respondents did not contest the fact of settlement. Relying on Supreme Court precedents (Gian Singh v. State of Punjab, Shiji v. Radhika, Manoj Sharma v. State of U.P.) the Court held that a successful mediation can justify quashing pending criminal proceedings. Consequently, the Court ordered the quashment of the proceedings against the applicants and incorporated the settlement report into the order. The application under Section 528 BNSS was disposed of, effecting the dismissal of the case.

Issues considered

  • Whether criminal proceedings pending under the B.N.S., D.P. and Muslim Women Protection Acts can be quashed on the basis of a settlement reached through mediation under Section 528 BNSS.
