Holding
The High Court held that the existence of an offence and the merits of the application under Section 528 BNSS cannot be determined at the interlocutory stage and therefore dismissed the application.
Summary
Rishabh Sharma filed an application under Section 528 of the BNSS challenging a sanction order of the Chief Judicial Magistrate, Muradabad, in a case instituted under Sections 3/25 of the Arms Act and 9(k)/1(k) of the Explosive Substances Act. The applicant alleged that no offence was made out against him and that the prosecution was malicious, seeking permission to file a discharge (unmochan) petition before the trial court. The State opposed the application. The High Court examined the submissions and held that the factual issues and the existence of an offence could not be decided at this interlocutory stage; such matters must be determined by the trial court after evidence is produced. Relying on several Supreme Court precedents, the Court declined to grant the relief and directed that the prayer be dismissed, noting that the applicant remains free to avail himself of the remedies provided by law. Consequently, the application was disposed of without any order granting the relief sought.
Issues considered
- Whether the applicant can be said to have committed an offence under the Arms Act and the Explosive Substances Act.
- Whether an application under Section 528 of the BNSS can be decided at the interlocutory stage without evidence.
- Whether the applicant is entitled to a discharge (unmochan) order before the trial court examines the merits of the case.
