Holding
The High Court held that it could not adjudicate the merits of the alleged offences at this stage and directed the applicant to file a discharge petition within a month before the trial court.
Summary
The applicant Arvind Kumar Gupta filed an application under Section 528 of the BNSS Act seeking discharge (उन्मोचन) in a criminal case (Criminal Appeal No 226/2025) pending before the Court of Judicial Magistrate‑First Class, Mirzapur. The applicant contended that he was innocent and that the order passed by the lower court was illegal and violative of several provisions of the Banking Act, the Indian Penal Code and the Copyright Act. The respondent opposed the application. The High Court held that the factual disputes raised by the applicant could not be resolved at the interlocutory stage and that the court could not decide on the merits of the alleged offences. Consequently, the Court directed the applicant to file a discharge petition before the trial court within one month, after which the trial court must decide the matter within two months based on the evidence. The application was therefore disposed of without granting the relief sought.
Issues considered
- Whether the High Court can entertain and decide an application under Section 528 BNSS to quash the order of the trial court at the preliminary stage
- Whether the allegations under Sections 60 Banking Act, 272,273,420,467,468,471 IPC and 54/63 Copyright Act constitute a prima facie case against the applicant
- Whether the applicant should be directed to file a discharge petition before the trial court
