Allahabad High Court

ASHOK KUMAR YADAVversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that it would not order payment of the dues but directed the respondent to consider the petitioner’s application dated 19‑03‑2025 and dispose of it within two months.

Summary

The petitioner filed a writ petition under Article 226 seeking a mandamus directing the respondent to release contractual dues of Rs.5,05,240 with interest and to decide the petitioner’s application dated 19‑03‑2025. The standing counsel raised no objection to the petitioner's application being decided by the competent authority. The Court, after hearing counsel, disposed of the writ petition, directing the respondent to consider the grievance raised in the 19‑03‑2025 application and to dispose of it expeditiously, preferably within two months of the certified copy of the order. No order for payment of the dues was issued. The order was to be reasoned and signed. The petition was thus disposed with a direction, not with the relief sought.

Issues considered

  • Whether the High Court may issue a writ of mandamus directing payment of contractual dues under Article 226
  • Whether the petitioner’s application dated 19‑03‑2025 should be decided by the respondent within a time‑bound period
