Allahabad High Court

PRASHANT KUMAR GUPTAversusUNION OF INDIA AND 2 OTHERS

Decided

Holding

The Court directed the petitioner to follow the established guidelines and the Regional Passport Officer to dispose of the passport application accordingly, and disposed of the petition.

Summary

Petitioner Prashant Kumar Gupta filed a writ petition under Article 226 seeking the disposal of his pending passport application. The respondents argued that a show‑cause notice had been issued because a criminal case (Case Crime No. 1215 of 2028 under IPC sections 323, 504, 506) was pending against him. The Court observed that the petitioner must first comply with the procedural guidelines laid down in the earlier judgments of Rahimuddin v. Union of India and Wajiruddin Khan v. Union of India. Accordingly, the Regional Passport Officer was directed to process the application in accordance with those guidelines and the timeline prescribed therein. The petition was consequently disposed of.

Issues considered

  • Whether a pending criminal case under IPC sections 323, 504, 506 bars the issuance of a passport.
  • Whether the High Court can direct the Regional Passport Officer to dispose of the passport application based on guidelines from earlier judgments.
