Allahabad High Court
PRAMOD KUMAR PANDEY AND 2 OTHERSversusTHE STATE OF U.P. AND 7 OTHERS
- Decided
Holding
The petition is dismissed as the matter has already been decided in earlier judgments and no fresh issue remains.
Summary
Petitioners Pramod Kumar Pandey and two others filed a writ petition under Article 226 seeking a mandamus directing the Uttar Pradesh State Medical Faculty, Lucknow to register their Bachelor of Physiotherapy degrees. The petitioners argued that the matter was not res integra, citing a 2018 Lucknow Bench judgment (Writ Petition No.8411 (MB) of 2009). The respondents concurred, contending that the petition should be disposed of in accordance with the earlier judgment and a 2023 order in Writ C No.15224 of 2013 (Pankaj Kumar Singh v. State of U.P.). The Court held that the earlier orders were binding and that there was no fresh issue to be decided. Consequently, the petition was dismissed and disposed of pursuant to the cited precedents.
Issues considered
- Whether the petitioners are entitled to registration of their Bachelor of Physiotherapy degrees by the State Medical Faculty.
- Whether the present petition raises a fresh question of law or fact (res integra).
