Allahabad High Court
HARBHAJAN SINGHversusUNION OF INDIA AND 3 OTHERS
- Decided
Holding
The petitioner must pursue the remedy under Section 34 of the Arbitration and Conciliation Act, 1996, and the writ petition is disposed.
Summary
Harbhajan Singh filed a writ petition before the Allahabad High Court challenging an arbitral award. The respondents argued that the petitioner had an alternative remedy under Section 34 of the Arbitration and Conciliation Act, 1996. The Court examined Section 34 and concluded that the petitioner indeed possessed an efficacious remedy by filing an application under that provision. Accordingly, the Court directed the petitioner to file the Section 34 application within one month and stipulated that it would be decided within two months thereafter. The writ petition was consequently disposed.
